Many Texas couples may be considering a divorce. While the decision to divorce is already quite difficult and emotional, some say that the current state of economy is adding to that stress and couples are putting it off. According to a recent survey, 38 percent of couples have postponed plans to divorce this year due to the recession.
More financial challenges may be present for couples these days. Some may have upside-down mortgages or at least one of the partners may be unemployed. Whatever the situation is, the goal of an amicable divorce is to protect assets and secure a positive future. With a few small adjustments, a couple does not need to postpone a divorce in order to achieve these goals.
A couple may want to consider drawing up a post-marital agreement. Much like a prenuptial agreement, a post-marital agreement serves as a list of assets. Both spouses then agree which assets will go to which spouse. The benefit of this document would be that when it is complete, both partners will have agreed on their own protected assets. It will also remove the fear that the other spouse will be given everything in family court.
It may also be beneficial to adjust the lifestyle expectations after the marriage has ended. The income that once supported one household must now sustain two. Concessions and compromises will be made. This may be one of the more difficult steps in a divorce. A couple may need financial planning assistance in order to draw up a budget that both spouses can live with.
Another suggestion is to work problems out through mediation in lieu of lengthy courtroom battles. Instead of fighting out smaller disagreements in court, participating in mediation may be a financially helpful option in some cases. However, it may not be a reality for all couples in all situations since many issues in a divorce can be complex.
